Terms of Service

Our agreement for analytical testing coordination, sample submission and authorized reports.

Version TA-TOS-2026-10-16-01 · Not yet effective

1. Introduction and our role

Trojan Analytics is an Ontario, Canada-based analytical-services coordinator. We review testing requests, arrange agreed analyses with independent laboratories, manage the order record and deliver authorized reports. Laboratory personnel perform the physical testing. A listed substance or method is not a promise that a particular sample or destination can be accepted.

We do not manufacture or sell peptides or other substances. These Terms concern analytical services, not a purchase of material or approval of its use. They apply to accepted work with the operator identified in the service agreement. A laboratory remains responsible for its own professional work; using a partner does not remove responsibilities we owe you under our agreement or applicable law.

2. Requests, quotations and your agreement

Submitting a request starts a suitability and scope review. It does not authorize shipment, testing or a charge. Before a service agreement is made, you must have an opportunity to review the supplier details, sample and analysis description, total price and currency, taxes and other charges, payment terms, receiving arrangements, performance information and applicable cancellation conditions, and to correct errors or decline.

The service agreement consists of the confirmed quotation, these Terms in the version expressly accepted and any specifically agreed written conditions. The quote must identify any departure from these Terms; mandatory legal rights always prevail. Acceptance of a quote authorizes only its stated work. Extra services and material price changes require further agreement. Keep the confirmation and an accessible copy of the agreement.

Where Ontario internet-agreement rules apply, required information must be supplied before agreement and a retainable written copy delivered within the statutory period. Missing disclosures or confirmation can give cancellation rights. Merely opening a page, maintaining an account or returning from a payment page does not demonstrate contractual acceptance or completed payment.

3. Analytical purposes and customer responsibilities

Services support research and analytical evaluation. Reports are not medical or veterinary diagnoses, treatment advice, approval for consumption, or human-use certification. A finding about identity or purity does not establish safety, sterility, therapeutic suitability, legality or regulatory approval.

You represent that you lawfully possess the sample, have authority to submit it and instruct analysis, and may share the accompanying information. Give accurate identifiers, expected contents, quantities, known hazards and relevant handling history; identify uncertainty honestly. Obtain authority before providing another person's information. Protect your account and notify us of suspected misuse.

We may refuse, suspend or stop work on prohibited, unsafe, misidentified, misrepresented or legally inadmissible material, or where an agreed method is unsuitable. We will explain the issue where lawful and assess unperformed work under the cancellation provisions. We may take protective steps required by law or a genuine safety concern; a refusal is not permission to ship elsewhere.

4. Shipping, customs and transport risks

Ship only after receiving approved instructions for your order. Confirm appropriate containers, packaging, labelling, quantities and handling with the assigned receiving facility. A packing slip or address label is not paid postage, a courier booking, a guaranteed delivery service or an import permit.

Unless separately agreed, you arrange and pay for transport and must use truthful customs declarations and lawful export/import procedures. Obtain necessary permits and agree responsibility for duties, taxes, clearance and importer-of-record obligations. Do not conceal or misdescribe a sample. We do not guarantee that a carrier or authority will accept or release it.

You bear transport risks arising from your packaging, declarations and carrier arrangements to the extent permitted by law. We remain responsible for loss caused by our own breach or fault to the extent applicable law requires. Laboratory custody and any transport we expressly arrange are governed by the agreed arrangements; risk is not transferred by a misleading label or tracking entry.

Loss, seizure, leakage, damage or delay may prevent analysis or require a replacement sample. We will review documented circumstances, available carrier remedies and the charges for work actually authorized. A transit problem does not automatically forfeit all payments or remove statutory cancellation/refund rights. Delivery scans alone do not prove laboratory intake or sample suitability.

5. Sample handling, destructive testing and disposal

Testing may consume, alter or destroy some or all of a sample. Only the retention, return and disposal arrangements confirmed for the actual laboratory and order apply. Do not rely on a standard storage period or return service unless expressly agreed before dispatch.

Remaining material may be retained or disposed of as agreed and as safety or law requires. Tell us before acceptance if you need retained material or further analysis; availability, lawful transport and charges require confirmation. We do not claim ownership of your material merely because you submit it, but you authorize the handling and consumption necessary for the agreed work.

6. Methods, turnaround and scientific limitations

Results apply to the sample examined under the reported methods and conditions. They do not certify an untested batch, other containers, a supplier or future stock. Sampling, preparation, degradation, reference materials, method suitability, detection limits and measurement uncertainty affect conclusions. An unexpected, negative or inconclusive result is not by itself evidence of a laboratory error.

Turnaround periods are estimates unless a specific commitment is agreed. Intake checks, customs, missing information, reference materials, laboratory capacity, technical failures and agreed payment conditions can affect timing. We will communicate material delays known to us and discuss appropriate options. A delay does not waive a mandatory cancellation right; work outside the agreed scope is not authorized merely because it might resolve uncertainty.

7. USD pricing, taxes and payment

New customer quotations and charges are in United States dollars (USD), with electronic amounts calculated in USD cents. The quotation must state quantities, service charges, discounts, taxes, fees, total obligations and payment timing. No undisclosed charge is authorized by these Terms. Historical transactions retain their recorded currency.

Pay only through a method we actually make available for the accepted quote. Payment is recorded after server-side confirmation, not from a success screen alone. Your bank or provider may levy its own currency-conversion or transaction charges. We do not set those rates. Internal laboratory costs, including any CAD acquisition costs, are separate from your quoted USD price.

8. Cancellation, refunds, failed analyses and retesting

You may cancel for a full refund before dispatching any sample, provided you have not separately authorized chargeable work that has already begun. Any such separate work and its cancellation treatment must have been clearly agreed. This does not restrict a statutory right to cancel or receive a full refund.

After dispatch, contact us promptly to stop work where practicable. Once preparation or testing has begun, completed work and reasonable, documented, non-recoverable costs that you authorized may be charged where lawful; unperformed work is not automatically non-refundable. We will explain any deduction and refund the remaining amount due. Statutory refund rights and deadlines prevail over this commercial allocation.

If we cannot supply the agreed analysis, we will explain the reason and offer an agreed alternative or the refund due for the affected unperformed service. Where a validated laboratory or equipment error makes the agreed analysis unreliable, we will arrange the affected analysis again without an additional testing charge where a suitable sample and method are available, or provide an appropriate refund if correction is not feasible. Other legal remedies remain available.

A sample with no target material, deterioration or inherent method limitations may validly produce a negative or inconclusive result. Work correctly performed remains chargeable where lawful. Extra tests, replacement samples or an independent retest require agreement on scope and costs; no unexpected result alone entitles either party to invent a finding.

Raise a cancellation, disputed result or payment concern through the contact channel with your order reference and supporting facts. We will investigate and explain our response. You do not have to give up lawful card-provider, chargeback, regulator or court rights while doing so. We may contest inaccurate claims using relevant records, without imposing an automatic penalty for a good-faith dispute.

9. Confidentiality and submitted information

We use customer and sample information to administer agreed services and disclose it only as needed to authorized providers, the receiving laboratory or lawful recipients. Confidentiality is subject to legal disclosure obligations, necessary safety measures and your explicit instructions. The Privacy Policy explains personal-information handling.

You retain rights in material and information you provide and give us permission to use them for the requested services. Original partner laboratory documentation is preserved separately from a customer-facing report as supporting evidence for authorized staff and reviewers. It is not automatically supplied to the public or licensed for unrestricted redistribution.

10. Reports, permitted use and COA verification

Subject to lawful payment conditions and authorized release, you may retain and use your customer report for the agreed analytical purpose and share a complete, unaltered copy lawfully. Rights in laboratory methods, source documentation, platform software, templates and branding remain with their respective owners. A report does not transfer those rights or grant an endorsement.

Do not fabricate, edit or selectively present results, identifiers, dates, qualifications or branding in a misleading way. Do not claim certification or accreditation the report does not establish. Do not present illustrative or TEST ONLY material as genuine. Request an authorized correction rather than changing a report yourself.

A genuinely released report can have a separately approved public summary. Its QR link opens the current record on https://trojananalytics.com/verify. Compare the displayed identifiers and findings with the document. A working QR link does not prove that a printed or downloaded copy is unaltered. Private, withdrawn, rejected and illustrative records do not become genuine through a copied QR code.

Private PDFs, original partner evidence, contact details and internal reviewer notes are excluded from public verification. Publication must follow the applicable notice and authorization process. A withdrawal or correction changes future verification but cannot retrieve independent copies already downloaded.

11. Warranties, responsibility and misuse

We will use reasonable care in coordinating the agreed services and communicating authorized results. Applicable statutory service-quality warranties and other mandatory rights remain in place. No report warrants the commercial quality, fitness, safety or legal use of the substance tested, or guarantees a particular analytical outcome.

To the extent permitted by law, we exclude indirect or consequential commercial losses, including lost business opportunities, arising from reliance beyond the agreed analytical purpose. This does not exclude non-waivable remedies, responsibility for our fraud or deliberate misconduct, or liability that law does not permit us to exclude. There is no arbitrary monetary liability cap in these Terms.

For business customers, to the extent enforceable, you must reimburse reasonable third-party claims and direct costs attributable to your unlawful submission, knowing material misdescription or fraudulent misuse of a report. This obligation is limited to your responsibility and does not cover our own fault or a laboratory's fault. We must notify you, allow a reasonable opportunity to respond and mitigate loss; we cannot agree a settlement at your expense without your reasonable consent. Consumer obligations are limited by applicable consumer law.

12. Complaints, governing law and changes

Contact Trojan Analytics with the relevant reference and an explanation of the concern. We will seek a practical resolution without making internal complaint handling a condition of exercising legal rights. Ontario law and applicable Canadian federal law govern, subject to mandatory law that protects you elsewhere. Ontario courts are the agreed forum to the extent lawful; this does not prevent a consumer using another court or authority where mandatory law permits.

Nothing in these Terms waives non-waivable consumer rights, requires mandatory arbitration or prevents a lawful collective claim. If a provision is unenforceable, it applies only to the lawful extent or is severed without rewriting mandatory protections. These Terms do not create enforceability guarantees.

New versions apply prospectively from their stated effective date and express acceptance where required. We will not silently replace the Terms accepted for an existing agreement or rewrite its currency. Contact and operator disclosures accompanying the agreement identify the contracting business; use the website contact form for current inquiries.
